Mortgage Debt Relief Act Extended for Another Year

Struggling homeowners who are considering a short sale or modification will be eligible for tax relief in 2013.

The “fiscal cliff bill” passed by Congress on January 1 included a provision to exclude borrowers from paying taxes on debt forgiven through a short sale, foreclosure, or loan modification.

Known as Mortgage Debt Relief Act of 2007, the act was scheduled to expire December 31, 2012, but received an extension for another year.

Industry experts and political leaders from all sides expressed support for the act’s extension.

In November, 41 state attorneys general wrote a letter urging U.S. House and Senate leaders to extend the act, arguing the act’s expiration would take away from the effectiveness of the national mortgage servicing settlement.

Through the settlement, state and federal officials reached an agreement with five of the largest servicers over “foreclosure abuses.” The settlement requires the servicers to provide $20 billion in consumer relief to struggling homeowners.

As of September 30, a report from settlement monitor Joseph Smith found servicers provided 21,833 borrowers with $2.55 billion in relief through first lien principal reduction modifications, which averages to about $116,929 in debt forgiveness for each borrower.

If the act did not receive an extension, borrowers who received relief in the form of forgiven debt would be liable to pay taxes on the debt.

I had 2532 Buena Vista Avenue open this past weekend with  approximately 35 visitor groups on Saturday and 50 plus on Sunday.  There has been a lot of anticipation by neighbors and passers by to see how the story ends with this investor flip. (Click before and after)

WCI 8th Grade Class Visits Larkey Park

If your driving by Larkey Park today you may have notice something different…It’s full of kids.

Today is the WCI 8th Grade Class Picnic at Larkey Park.  The pool, tennis courts, basketball court, were a bee hive of activity.

In just a few days they have their final class of the year June 8, 2012…Congratulations WCI 8th Grade!!

The “Larkey Area” has so much to offer from a lifestyle point of view,… the park, museum, trails, etc. It also presents wonderful real estate opportunities. We have little niche subdivision communities, Eichler style flat tops, flag lots & stunning view lots.  There really is something for everyone.

This brings us to our subject property today, 1831 2nd Avenue is none of these.  It’s an old 1937 Mediterranean Style home that sits on approximately one flat acre. It reminds us of our agricultural heritage.  Standing in the master bedroom and looking out to the backyard ( through the floor to ceiling windows) it is easy to forget your just about one mile to the 680/24 interchange.

You probably saw real estate signs come and go.  At the height of the market the owners ( and there agents ) we fishing for a $2M buyer. 

Finally it went back to the bank with 2 years of deferred maintenance, it was pretty torn up!
